GENERAL TERMS AND CONDITIONS – MY DALMATIA
1. IN GENERAL
Our collection of holiday homes is chosen according to high-quality standards. Each holiday home was personally inspected and all advertised units are under contract with MY DALMATIA. All properties have licenses issued by the competent state authorities. The company My Dalmatia, online tourist agency, (hereinafter referred to as the agency) guarantees the authenticity of the visual documentation provided and displayed on our web page www.my-dalmatia.com. We also guarantee the accuracy of the conditions under which the accommodations are offered.
2. CONTRACT
The rental contract, which you enter into with My Dalmatia as an agent, you as a lesse (hereinafter: guest ) actually conclude with the lessor (hereinafter: Owner).
My Dalmatia acts exclusively as an agent and it shall be liable only as an agent. By paying an advance for the reservation of the selected holiday unit in the demanded period you unconditionally accept these General Business Terms and Conditions. My Dalmatia retains the right of change of these General conditions which shall be published on the web page www.my-dalmatia.com and which come into force on the day of publishing. We may modify our terms and conditions without notice at any time where such amendment does not substantially affect your rights and obligations. If such changes of our terms and conditions substantially affect your rights and obligations, we will notify you by email of these changes as they occur. After the completion of the reservation process and payment, My Dalmatia shall send a written reservation confirmation ( hereinafter: voucher ) by email. The voucher with these General Business Terms and Conditions makes a Rental contract between the guest and owner.
It is important that you check the voucher you receive from us immediately on receipt. You must contact us straight away if any information appears to be incorrect as it may not be possible to make changes later.
3. INQUIRIES AND BOOKING
Inquiries for booking the accommodation capacities shall be received primarily electronically. While creating an accommodation booking request, the guest confirms that he/she is acquainted with the Terms and conditions, that he has read them carefully, and accepts them in their entirety. Everything stated in the Terms and conditions represents a legal commitment for the guest and the agency. The guest shall provide all data required by the booking process. In order for the booking to be valid, the guest must pay an advance payment within 72 hours after the inquiry, or the booking shall be removed, while the agency withholds the right to subsequently offer that time slot for sale. The advanced payment is 30% of the total amount of the service. The accepted method of payment is bank transfer. By depositing the advance payment, the guest shall be deemed to be acquainted with the Terms and conditions and that he unconditionally accepts them in their entirety. In case the guest cancels the booking, the agency shall not refund the deposited advanced payment.
The remaining 70% of the total lease amount for a certain accommodation shall be settled no longer than five weeks (35 days) prior to the check-in date. In case the guest does not pay the remaining lease amount (the remaining amount after the advance payment) prior to arriving at his destination within
the given deadline, the agency withholds the right to cancel the booking. After receiving the deposited advance payment, the agency shall send a written booking confirmation (Voucher) to the guest containing all necessary information regarding the booked accommodation.
The lease contract is voidable in case the entire remaining lease amount is not received at least 5 weeks (35 days) prior to arriving at the destination, i.e., five weeks (35 days) prior to the first day of the time slot for which a certain unit has been booked. The remaining amount shall be paid by bank transfer to the agency’s account. In case the booking is made within the five weeks (35 days) period prior to arriving at the destination, i.e., five weeks (35 days) prior to the first day of the time slot for which a certain unit has been booked - the possibility of paying the deposit shall not be offered, but rather the total amount which should be paid within 24 hours after the inquiry. The written booking confirmation (Voucher), contains the following data:
• the start and the end date of the booking period, i.e., the lease of a certain unit
• the specified time when the guest can arrive at the leased accommodation capacity
• the specified time of the guest’s departure from the leased accommodation capacity
• the address of the accommodation
• the price of the lease
• the number of persons staying in the accommodation
• the service specification included in the price of the leased accommodation capacity
• the amount paid in advance
• the remaining amount of 70% and the date until which the amount has to be paid
• the specification of possible additional expenses:
- the sojourn tax
- pets (the amount varies for each unit),
- final cleaning (the amount varies for each unit),
- security deposit in case damage to the unit or the unit’s inventory occurs (the amount varies for each unit),
The written booking confirmation (voucher) will be sent to the guest via e-mail after the advance payment deposit and the remaining total amount deposit have been received.
4. CANCELLATIONS AND CHANGES
If you wish to cancel or partially cancel your reservation, you can do so by sending a written request by email to rental@my-dalmatia.com. The denunciation shall take effect only from the date on which it is terminated and My Dalmatia receives such a notice of cancellation and only under the terms of this clause. In case of the cancellation of the Rental contract all received payments are retained untill the date of cancellation, and the guest is not entitled to their return.
In the event that a guest in the same period, for the same price and under same conditions can find another guest as a replacement, My Dalmatia will transfer Rental contract to the new guest immediatelly upon written receipt of all necessaray information about the new guest and will send him a written confirmation. Already received accomodation price amounts will be retained by My Dalmatia after the transferred contract, and the new guest is obliged to pay the rest up to the total price of accomodation via bank transfer.If you are prevented from traveling, you have the right to transfer the reservation to another person and / or to another date if approved by the property owner. If you wish to make other changes to your booking after it has been confirmed, you must notify us as soon as possible.
The following cancellation charges apply:
36 days prior to holiday home check in........................................30 % of total cost
35 days – 0 days prior to holiday home check in........................100 % of total cost
5. SERVICE PRICES
The agency reserves the right to change the prices at any time. The price change shall not affect the bookings that have already been confirmed. The service price is stated on the agency’s website www.my-dalmatia.com. For all types of special services that have been stated as optional, the guest shall pay additionaly and shall choose them while the booking process is still underway.
The water, gas, electricity and internet costs, as well as bedding, towels, kitchen cloths, final interior cleaning, pool and environment maintenance, are included in the total accommodation lease price unless otherwise agreed with the lessor. In case it has been otherwise agreed with the lessor, it shall be stated in the apartment descriptions that are published on the agency’s website.
6. TIME OF ARRIVAL AND DEPARTURE OF THE GUEST
The guest shall receive a notice no later than 7 days before the day of arrival, containing information about the time of arrival and departure. In case of an earlier arrival, the guest will not be able to enter the accommodation unit before the time of the arrival mentioned in the voucher, unless otherwise agreed before arrival. Check-out must always be no later than 10.00 am on the day of departure, and the guest is obliged to return the keys to the owner. In case of a departure that takes place later than agreed, the guest is obliged to pay the owner (if agreed) all additional costs that the owner charges on the spot.
7. GUEST’S OBLIGATIONS
The guest shall:
• hold valid travel documents
• comply with customs and exchange legislation of the destination state
• observe the house rules in accommodation units and cooperate in good faith with the service providers
• upon arriving at the destination, give the voucher with an exact number of persons and type of services that are to be provided to the service provider. (Voucher received by e-mail)
• the traveler shall check whether a visa is necessary to enter the destination state or neighboring states.
The guest shall leave the accommodation unit in the same state in which the unit was handed over to him for use based on the lease contract. He/she shall clean the unit before departing, regardless of the status of the accommodation service provider’s final cleaning service. In case the guest, after departing from the accommodation unit, does not leave the unit in the same state in which it was handed over to use based on the lease contract, and this results in the following guest being unable to enter the accommodation unit within the agreed deadline, the guest whose actions caused this damage shall be held materially liable for any consequence. The guest shall be held liable for any damage caused during his/her stay at the unit A security deposit was therefore introduced for certain units, which varies depending on the agency and lessor’s cooperation model, i.e., contract between the agency and lessor.
8. INSURANCE DEPOSIT AND CLAIMS
Upon arrival at the facility, the guest is obliged to leave a cash deposit to cover the possible damage. The amount of the deposit that the guest is obliged to provide to the owner upon arrival will be stated in the voucher. The deposit serves as insurance to the owner for the possible damage caused to the property, and the owner has the right to settle the damage from the deposited amount. In case the damage is greater than the deposited amount, the guest is obliged to compensate the total amount of damage that the owner has incurred. If no damage has been caused to the property, the owner is obliged to return the deposited amount to the guest at the check-out time. If you discover any problems or malfunctions upon arrival, report them immediately to avoid misunderstandings after your rental period ends.
Intentional damage to property or breach of public order is considered a serious violation of the provisions of the Lease Agreement, in which case the owner and/or My Dalmatia are authorized to terminate the lease which enters into force immediately, without notice, and the guest is obliged to permanently leave the property within 2 (two) hours together with all persons staying there, and has no right to demand a refund of the paid price of accommodation from the owner or from My Dalmatia. The guest is obliged to immediately report to the owner the occurrence of any damage to the building during the rental period. When the guest leaves and before the keys are returned, the guest is obliged to inspect the property. All possible disputes will be directly resolved between the owner and the guest. My Dalmatia only acts as the mediator
9. HOUSE RULES, NOISE AND ENTERTAINMENT IN ACCOMMODATION UNITS
Guests are required to follow the house rules. Each property has its own house rules that are placed in a visible place and are available to the guest. If the guests do not follow the rules of the house, it can be considered a serious violation of the provisions of the rental agreement, in which case the owner and/or My Dalmatia have the right to terminate the rental agreement which takes effect immediately, without notice, and the guest is obliged to permanently leave the property with all persons staying there within 2 (two) hours and has no right to demand a refund of the paid accommodation price from the owner or My Dalmatia.
Guests are not allowed to organize parties in the house and/or around the property. In the event that guests violate public order with noise and do not calm down after the warning, this can be considered a serious violation of the provisions of the lease agreement, in which case the owner and/or My Dalmatia is authorized to terminate the lease agreement which takes effect immediately, without notice, and the guest is obliged to permanently leave the property together with all persons staying there within 2 (two) hours and has no right to demand a refund of the paid accommodation price form of owner or My Dalmatia.
10. CAPACITY
The number of persons accommodated in the property and the space belonging to it cannot be higher than the one stated in the voucher. This number of people includes children regardless of their age. After the start of the rental, the guest is obliged to announce in advance all visitors who come to visit him. If more than the maximum number of persons remains in possession or in possession around it without the approval of the owner, the owner and/or My Dalmatia reserve the right to terminate the lease which enters into force immediately without notice period, and the guest is obliged to leave the property permanently together with all persons staying there within 2 (two) hours, and has no right to demand a refund from the owner or My Dalmatia.
11. YOUNG GROUPS
In case the guests are under 25 years old, they are obliged to inform My Dalmatia about the exact number of guests and their age. My Dalmatia and the owner reserve the right to refuse groups of guests under the age of 25 in the event that My Dalmatia has not been notified of their arrival, in which case guests are not entitled to a refund of the paid accommodation price.
12. PETS AND THE ENVIRONMENT OF ACCOMMODATION UNITS
The permit for keeping pets will be marked on the website www.my-dalmatia.com in each accommodation unit that allows pets under the conditions provided for each property separately. Any additional cleaning costs for pets will be clearly stated on the facility’s website. In case the guest wants to bring more than 1 (one) pet, he must additionally contact the agency, and without written permission, it will not be allowed to keep more than 1 (one) pet on the property. Pet owners are responsible for cleaning up pet debris, and pets are not allowed to sit on furniture at any time. Any evidence of keeping a pet on furniture can cause additional cleaning costs. Keeping pets on the property is the sole responsibility of the guest, and the owners and the agency do not take any responsibility for any possible illness or injury that the pets may suffer during their stay. Access to swimming pools (if available in the facility) is strictly prohibited for pets.
Pets are not allowed in some facilities. However, neither the owner nor the agency can guarantee that there were no pets in the house before. My Dalmatia does not take responsibility for allergic reactions of guests that may occur in any of the accommodation units. If the guest brings a pet that has not been announced, the owner and/or My Dalmatia reserves the right to terminate the lease agreement which takes effect immediately, without notice, and the guest is obliged to permanently leave the property within 2 (two) hours with all persons who reside there and he has no right to demand from the owner or from the Agency a refund of the paid price of accommodation. Guests should be aware that some of our properties are in rural or isolated locations, so you can find flora and fauna such as mosquitoes, wasps, ants, domestic animals, etc., as well as other environmental activities, such as agriculture. My Dalmatia cannot be held responsible for any construction or road works that occur in the vicinity of the property. My Dalmatia will endeavor to advise you of any ongoing activity, but activities or unplanned events may occur at any time without our prior knowledge.
13. SWIMMING POOL
The guest is obliged to follow the instructions of any kind relating to the use of the pool (if available on the property) given by the owner or My Dalmatia for their own safety. The guest is responsible for the use of the pool (if available in the facility) in any sense. Children must not be present in the pool area without adult supervision. The guest uses the pool at his own risk. If the accommodation is booked outside the summer season, it could happen that the pool is no longer used. You should consider that pool use is associated with certain health risks and use them at your own risk.
14. TECHNICAL EQUIPMENT
The properties advertised on the website www.my-dalmatia.com contain all the necessary devices, technical equipment and other benefits that ensure a pleasant stay of the guest. The owner is obliged to ensure the correct function of all devices in the property. In the event of a malfunction of any of the devices, the guest is obliged to notify the owner and / or My Dalmatia of the situation so that My Dalmatia can request the owner to arrange a repair immediately and eliminate the fault as soon as possible. The owner is obliged to remove the reported defect within a reasonable time. The owner is directly responsible to the tenant for malfunctions, and My Dalmatia will take all possible steps to repair or remove the malfunctions or other irregularities as soon as possible.
15. COMPLAINTS
If a guest has problems with the booked accommodation unit, such as insufficient cleaning, damage or other irregularities, he should immediately notify My Dalmatia and the property owner so we are able to correct this in a timely manner. If the complaint is not resolved satisfactorily for the guest, the guest is then obliged to contact My Dalmatia directly in order to resolve the complaint satisfactorily.

16. SPECIAL REQUIREMENTS
If the guest has special requirements that are not included in the price of accommodation (such as chefs, waiters, special food, etc.), the agency will fulfill them if possible. Additional/Special services must be announced in advance by e-mail in order to be fulfilled. My Dalmatia cannot be held responsible for the quality of services provided by third parties.
17. MAJEURE FORCE
In the event that the concluded lease agreement cannot be fulfilled or its fulfillment becomes significantly more difficult due to Force Majeure (e.g. war, natural disasters, environmental disasters, epidemics, border closures, strikes, etc.) which could not have been foreseen at the time of conclusion of the Lease Agreement, My Dalmatia and the owner may terminate the Lease Agreement because neither My Dalmatia nor the owner can be held liable in the above cases.
18. PERSONAL DATA PROTECTION AND PRIVACY STATEMENT
The Personal Data Protection and the Privacy Statement primarily serve to protect the privacy of our users. In case you decide to use one of our services, it is necessary to provide the requested personal data in order for us to complete the booking and lease of the requested service, but your personal data remain under maximum protection and will be solely used for the process of realizing the requested services. We emphasize that we only collect the data that is needed to regularly carry out the procedure related to the lease of a chosen service and that during the process we solely use the information that you provided My Dalmatia tourist agency can reveal personal information solely if it is required by the law or a judicial decision and if there is a need for the protection of the personal safety of the user or the public.
